CONSENT, WAIVER AND EXPLICIT CONSENT DECLARATION

1. Parties and Subject

This Declaration has been drawn up by the ASSOCIATION FOR INTRODUCING, RESEARCHING AND TEACHING THE JAFARI FAITH (hereinafter referred to as “CAFERİDER”) in connection with the theatre screenplay competition titled “ASHURA THEATRE SCREENPLAY” (hereinafter referred to as the “Competition”), announced to be held on 01.09.2026, for the purpose of determining the transfer, use and processing of the economic, moral and neighbouring rights in the work/piece I submit, and the terms of my explicit consent.

2. Declarations, Acceptances and Undertakings

Regarding the written work/screenplay that I submit, for the purpose of applying to the Competition, via the e-mail address or other communication channels specified by CAFERİDER in the competition rules;

1. That it is entirely written by me, that it is an original work, and that all intellectual and industrial property rights and the power of disposal over the work belong to me personally, and that it does not infringe the rights of any third party,
2. That should the above declarations prove to be untrue, any and all legal and criminal liability arising therefrom belongs exclusively to me, and that I shall hold CAFERİDER harmless from any and all damage it incurs or may incur for this reason,
3. That I accept that, following the announcement of the Competition results, should a false declaration be established, CAFERİDER has the right to reclaim and/or cancel the prize,
4. That, regardless of whether or not the work is placed in the Competition or is considered for evaluation for any reason, and effective from the moment I take part in/submit to the Competition;

a. Transfer of Economic Rights and Right of Use: I transfer to CAFERİDER, irrevocably and without limitation as to duration, place, number, medium or country, all economic rights in the work — including but not limited to the rights of Adaptation (FSEK Art. 21), Reproduction (FSEK Art. 22), Distribution (FSEK Art. 23), Performance (FSEK Art. 24) and Communication to the Public by Means Suitable for the Transmission of Signal, Sound and/or Image (FSEK Art. 25) as set out in Law No. 5846 on Intellectual and Artistic Works (“FSEK”); and that it is entirely at CAFERİDER's discretion, at any date, whether the work in whole or in part, as is or with modifications/adaptations deemed appropriate by CAFERİDER, is staged as a theatre play, made into a video, given a voice-over, transferred to audiovisual media, or used in readings, talks, presentations, promotional and similar events, and on social media and all other digital/print media,

b. Unlimited Medium and Format: That CAFERİDER has the exclusive authority to record the work onto a master copy, video master tape, digital recording media and all other data carriers; to produce new copies from these recordings; and to publish, reproduce, rent, sell or communicate it to the public on VCD, DVD, CD, Blu-Ray, USB, digital content platforms (OTT/VOD), television, radio, SMS, the internet, social media, cinema, wired/wireless/satellite broadcasts and any technical method and medium to be developed in the future,

c. Waiver of Rights and Financial Claims: That the decision as to whether or not the screenplay is adapted as a theatre play, film, digital content or otherwise rests entirely with CAFERİDER; that I shall not make any claim for any royalty, licence, performer's/interpreter's neighbouring right, or any other financial/moral compensation, fee or right whatsoever, arising from the results of the Competition or from the use/non-use of the work by CAFERİDER in the manner set out above, and that I irrevocably waive these rights — this I accept, declare and undertake.

3. Cancellation, Modification and No Compensation for the Competition

CAFERİDER reserves the right to cancel the Competition in whole or in part, to postpone it to a later date, and to make changes at any time to the Competition's calendar, rules or conditions. I irrevocably accept, declare and undertake that, in the event the Competition is cancelled, postponed, or its conditions or dates are changed, I shall not make any claim of any kind whatsoever — right, receivable, loss of profit, expense or financial/moral compensation — against CAFERİDER, its Officials or the Organisation, by reason of having applied to/taken part in the Competition.

I declare and accept that I have read and understood this Consent, Waiver and Explicit Consent Declaration, and that I accept it of my own free will, being aware of its legal consequences.
